
FRESH NORMAL AT NCLT & NCLAT– ONLINE HEARING
The Year 2020 is an extraordinary year in a unique era. Technology helps us survive. The two Tribunals (online hearing process at NCLT and NCLAT) have only been hearing urgent matters until recently. Now the Tribunals court are moving to standard case lists. In a new standard procedure, the courts will hear issues in video conferencing mode.
The Circular/Order of 25 November 2020 issued by the National Company Law Tribunal notes that the NCLT Benches are now reconstituted to attend a daily hearing by video conferencing with effect from 1 December 2020. The Benches shall hear the issues of their respective area as they were heard before the lockdown (before 23rd March 2020). All matters, including those pending before the lockdown, shall be heard on a routine basis on all business days. The Benches shall be regulated by Rule 9 of the NCLT Rules 2016, NCLAT will issue the fresh normal protocol for virtual hearings, The Appeals Tribunal agreed to hear all urgent matters by video conferencing only and all work, including the reference to urgent matters, will be done online.
From 23, March 2020, the National Company Law Tribunal New Delhi Benches have announced new dates 10 times: 3 June 2020, 12 June 2020, 30 June 2020, 17 July 2020, 4 Aug 2020, 19 Aug 2020, 4 Sept 2020, 30 Sept 2020, 9 Oct 2020 and, finally, 29 Oct 2020.
The High Court of Delhi has today been told that the National Company Law Tribunal (NCLT) has provided its virtual hearing to all parties by developing a common connection to the courtroom in the cause list. (Deepak Kholsa vs National Company Law Appellate Tribunal & Ors)
