Compliance to start a food company will be sent to the FSSAI license including electronic registration on the FSSAI website and a paper file drafted in compliance with the licensing criteria of the central / state licensing / registration. The application for Food Business Operator License in the prescribed format along withsupporting documents, Based on the application and supporting documents, FSSAI will accord approval.The list of documents required for conversion of license, whereas for new license application there are 18 to 24 types of documents to be attached to apply.

Blueprint / Layout Map indicating measurements in meters / square meters and operating area distribution (Manufacturing and Processing Units Obligatory only)
Names of Directors / Partners / Proprietor / Society / Trust Board Members with complete address and contact information (compulsory for businesses only)
Title and description of equipment and apparatus along with number, installed capability and horse power used (compulsory for manufacturing and distribution units only)
Image I.D and address evidence provided by the Proprietor / Partner / Director Government Authority(s)/Authorised Signatory. (optional)
List of food category desired to be manufactured. (In case of manufacturers)
Authority letter including name and address of responsible owner appointed by the producer along with alternate responsible citizen showing the powers viz assisting officers in checks, sample processing, packaging and dispatch. (For manufacturers / processors)
Recall plan where appropriate, including specifics of the drug being shipped. (Optional)
Water residue test for units producing bottled drinking water, bottled mineral water and/or carbonated water from a Recognized / Public Health Laboratory
Supporting documentary proof for Turnover

Providing documentary proof for 100% EOU
Regional or Local Health Certificate of the Ministry of Commerce. (optional)
Analysis report (Chemical & Bacteriological) of water to be used as ingredient in food from a recognized/ public health laboratory to confirm the portability (mandatory only for manufacturing and processing units only)
Proof of possession of premises. (Sale deed/ Rent agreement / Electricity bill, etc.) (optional)
Agreement Deed / Affidavit of Proprietorship / Memorandum & Articles of Association on the creation of the company. (Optional) – For MoA – Three documents must be submitted (First page –incorporation certificate, Second page – Authorisation of Food industry operation and Third page – list of directors with addresses)
Print of certificate received for cooperatives under Coop Act – 1861/Multi State Coop Act – 2002. (Where applicable)
NOC from the supplier (obligatory for re-labellers and re-packers only)
Food health management program strategy or credential (if applicable)
Origin of milk or milk supply strategy including milk collection center position etc. For manufacturing systems for Milk and Milk Products.(where applicable)
Origin of raw material for dairy and beef manufacturing plants (wherever applicable)

What is a Food Business Operator License?

A Food Business Operator License is a license granted by the Food Safety and Standards Authority of India that allows the entity to carry on activities related to any stage of manufacturing, processing, packaging, storage, transportation, distribution of food, import and includes food services, catering services, sale of food or food ingredients.PFA,Act 1954 is now amended to new Food Safety and Standards Act (FSSA), 2006 introduced to improve the hygiene and quality of food has brought about tremendous changes in the food industry. Therefore, any organized food manufacturing or processing or packaging or distributing entity is now required to obtain a Food Business Operator License prior to commencing business.

FSSAI LICENSE REQUIREMENT FOR FOOD BUSINESS OPERATORS (FBO) AND ITS APPLICABILITY:

Food Business Operator License is issued by the Food Safety and Standards Authority of India (FSSAI), Ministry of Family Health & Welfare, Government of India.As per new FSSA Rules, 2011 all existing and new Food Business Operators (FBO) has to mandatory convert their existing PFA, FPO, MMPO Licenses to new FSSA License. It is mandatory to obtain FSSAI License before starting of any Food Business. This is applicable to all food units involved into Manufacturing, Processing, Import, Trading, Packing, Distribution, Storage, Transportation, Warehousing, Sales, Re-packing, Re-labelling, Wholesale, Retail, Hotel, Canteen, Dhaba, Restaurant, Club and Resorts or any kind of food business in India.
Why is Food Business Operator License required?

The Food Safety and Standards Act, 2006 has made it mandatory for entities involved in the activities related to manufacturing, processing, packaging, storage, transportation, distribution of food or food ingredients to obtain a Food Business Operator License prior to commencing business.

Food Business Operator License issued by FSSAI is required for carrying on activities related to any stage of manufacturing, processing, packaging, storage, transportation, distribution of food.

Hawkers and Cottage Industries

Petty retailer, hawker, itinerant vendor or a temporary stallholder or small scale or cottage or such other industries relating to food business or tiny food business operator are exempt from obtaining Food Business Operator License.

Validity

Once a Food Business Operator License is issued, it is valid for one or two years. Before end of its validity, the license can be renewed for a further term based on the requirements.

License Categories

Food Business Operator License can be divided into two categories State level License and Central License. Hotel, Restaurant and medium size food manufacturers are covered under State license. Large size food manufacturers come under Central licensing.

Location Specific

A separate Food Business Operator License required and issued for each location where food is handled. Therefore, an entity may have to obtain multiple food business operator licenses if it operates multiple locations.

What are the categories of Food Business Operator License?

Food Business License can be mainly divided into two categories, state level license and central license. Hotels, Restaurants, Millers with production of less than 1MT per day and other small or medium scale manufactures come under the state level license. Food importers, caterers catering to Railways, Air, Defense establishments and large scale food manufacturers come under the purview of the central license.
Who must obtain Food Business Operator License?

Any person or entity involved in activities related to any stage of manufacturing, processing, packaging, storage, transportation, distribution of food, import and includes food services, catering services, sale of food or food ingredients must obtain Food Business Operator License. How to apply FBO (Food Business Operator)License & Process?

How to apply: FBOs will have to provide valid personal e-mail ID and and an active mobile number to apply for the registration/license through the online registration system. Upon successful submission, FBOs will be provided with a unique reference ID for the application. FBOs then need to take a print out of the application and attach the Demand Draft for the fee and supported documents required as part of the application and submit the application to the State Authority or Regional Office of Food Safety and Standards Authority of India, within 15 days from the date of submission of application online.
