What is IPR(Intellectual Property Right)?
- IPR(Intellectual Property Right) has not defined in GST Law. Intellectual property is generated by the application of intelligence, which can take the form of a design, an invention, technology, a book, a product, a procedure, or goodwill etc (MF(DR) circular No. B2/8/2004-TRU dated 10-9-2004)
Central Board of Indirect Taxes and Customs though Notification has further modified notification No. 01/2017- GST rate on permanent transfer of Intellectual Property Right (“IPR”) in respect of goods by increasing goods and services tax rate from 12% to 18% and CBIC has been amend it at par with supply of services. (Notification No. 13/2021-dated Oct 27, 2021)
