Documents Required for New License Application

  • Form-B Duly completed and signed (In Duplicate) by the Proprietor/Partner or the Authorized Signatory
  • Blueprint/layout plan of the processing unit showing the dimensions in metres/square meters and operation-wise area allocation (mandatory for manufacturing and processing units only)
  • List of Directors / Partners / Proprietor / Executive Members of Society/Trust with full address and contact details (mandatory for companies only)
  • Name and List of Equipment’s and Machinery along with the number, installed capacity and horse power used (mandatory for manufacturing and processing units only)
  • Photo I.D and address proof issued by Government authority of Proprietor/Partner/Director(s)/Authorised Signatory. (optional)
  • List of food category desired to be manufactured. (In case of manufacturers)
  • Authority letter with name and address of responsible person nominated by the manufacturer along with alternative responsible person indicating the powers vested with them viz assisting the officers in inspections, collection of samples, packing & dispatch. (for manufacturers / processors)
  • Recall plan wherever applicable, with details on whom the product is distributed. (optional)
  • Pesticide residues report of water in case of units manufacturing packaged drinking water, packaged Mineral water and/or carbonated water from a recognised/ public health laboratory
  • Supporting documentary proof for Turnover
  • Ministry of Commerce Certificate for 100% EOU
  • NOCs from Municipality or local body. (optional)
  • Analysis report (Chemical & Bacteriological) of water to be used as ingredient in food from a recognized/ public health laboratory to confirm the portability (mandatory only for manufacturing and processing units only)
  • Proof of possession of premises. (Sale deed/ Rent agreement / Electricity bill, etc.) (optional)
  • Partnership Deed/Affidavit of Proprietorship/Memorandum & Articles of Association towards the constitution of the firm. (optional) – For MoA – Three pages need to be uploaded (First page – Certification of incorporation, Second page – Authorization of food business activity and Third page – list of directors with addresses)
  • Copy of certificate obtained under Coop Act – 1861/Multi State Coop Act – 2002 in case of Cooperatives. (wherever applicable)
  • NOC from manufacturer (mandatory for re-labellers and re-packers only)
  • Food Safety Management System plan or certificate (if any)
  • Source of milk or procurement plan for milk including location of milk collection centers etc. in case of Milk and Milk Products processing units.(wherever applicable)
  • Source of raw material for meat and meat processing plants. (wherever applicable)
  • NOC/PA document issued by FSSAI (In case of multiple documents, merge them into one document and then upload)

    A Food Business Operator License is a license granted by the Food Safety and Standards Authority of India that allows the entity to carry on activities related to any stage of manufacturing, processing, packaging, storage, transportation, distribution of food, import and includes food services, catering services, sale of food or food ingredients.PFA,Act 1954 is now amended to new Food Safety and Standards Act (FSSA), 2006 introduced to improve the hygiene and quality of food has brought about tremendous changes in the food industry. Therefore, any organized food manufacturing or processing or packaging or distributing entity is now required to obtain a Food Business Operator License prior to commencing business.

    FSSAI LICENSE REQUIREMENT FOR FOOD BUSINESS OPERATORS (FBO) AND ITS APPLICABILITY:

    Food Business Operator License is issued by the Food Safety and Standards Authority of India (FSSAI), Ministry of Family Health & Welfare, Government of India.As per new FSSA Rules, 2011 all existing and new Food Business Operators (FBO) has to mandatory convert their existing PFA, FPO, MMPO Licenses to new FSSA License. It is mandatory to obtain FSSAI License before starting of any Food Business. This is applicable to all food units involved into Manufacturing, Processing, Import, Trading, Packing, Distribution, Storage, Transportation, Warehousing, Sales, Re-packing, Re-labelling, Wholesale, Retail, Hotel, Canteen, Dhaba, Restaurant, Club and Resorts or any kind of food business in India.

    Food Business License

    Food Business Operator License issued by FSSAI is required for carrying on activities related to any stage of manufacturing, processing, packaging, storage, transportation, distribution of food.

    Hawkers and Cottage Industries

    Petty retailer, hawker, itinerant vendor or a temporary stallholder or small scale or cottage or such other industries relating to food business or tiny food business operator are exempt from obtaining Food Business Operator License.

    Validity

    Once a Food Business Operator License is issued, it is valid for one or two years. Before end of its validity, the license can be renewed for a further term based on the requirements.

    License Categories

    Food Business Operator License can be divided into two categories State level License and Central License. Hotel, Restaurant and medium size food manufacturers are covered under State license. Large size food manufacturers come under Central licensing.

    Location Specific

    A separate Food Business Operator License required and issued for each location where food is handled. Therefore, an entity may have to obtain multiple food business operator licenses if it operates multiple locations.

  • What are the categories of Food Business Operator License?

    Food Business License can be mainly divided into two categories, state level license and central license. Hotels, Restaurants, Millers with production of less than 1MT per day and other small or medium scale manufactures come under the state level license. Food importers, caterers catering to Railways, Air, Defense establishments and large scale food manufacturers come under the purview of the central license.

    Any person or entity involved in activities related to any stage of manufacturing, processing, packaging, storage, transportation, distribution of food, import and includes food services, catering services, sale of food or food ingredients must obtain Food Business Operator License.   • How to apply FBO (Food Business Operator)License & Process?

    How to apply: FBOs will have to provide valid personal e-mail ID and and an active mobile number to apply for the registration/license through the online registration system. Upon successful submission, FBOs will be provided with a unique reference ID for the application. FBOs then need to take a print out of the application and attach the Demand Draft for the fee and supported documents required as part of the application and submit the application to the State Authority or Regional Office of Food Safety and Standards Authority of India, within 15 days from the date of submission of application online.

    Operating food business without license is punishable with imprisonment of upto six months and also with a fine of not more than five lakh rupees.
