of its clients.<\/p>\n<h1><span class=\"ez-toc-section\" id=\"When_is_required_to_File_e-Form_DIR_3_KYC\"><\/span><span id=\"Who_is_required_to_File_e-Form_DIR_3_KYC\" style=\"color: #ffcc00;\"><strong><b>When is required to <a href=\"https:\/\/www.caindelhiindia.com\/blog\/all-about-the-director-kyc-dir-3-kyc-filing\/\">File e-Form DIR 3 KYC<\/a>?<\/b><\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p>According to Ministry of Corporate Affairs Rule 12A of <strong>Companies (Appointment and Qualification of Directors) Rules, 2014<\/strong>, the below person needs to file form <em>Director Identification Number &#8211;<\/em>DIR-3 KYC:<\/p>\n<ul>\n<li>The person holds <em>Director Identification Number<\/em>\u00a0as on 31<sup>st\u00a0<\/sup>March of any FY<\/li>\n<li>when any change in the Know your customer (KYC) like passport, mobile number, PAN details, address proof &amp; email ID.<\/li>\n<li>Disqualified Directors<\/li>\n<li>A person having multiple <em>Director Identification Number<\/em>, after surrendering the multiple DINs\u2019<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Central Government has extended the KYC for Directors as well.<\/p>\n<p style=\"text-align: justify;\">Just like Bank KYC, where governments want to know the Director and expect them to submit a yearly intimation about KYC and any changes, if any, in the details.<\/p>\n<p style=\"text-align: justify;\">It&#8217;s a form first time introduced by the Ministry of Corporate Affairs (MCA) wide its notification dated July 5, 2018, by issuing an amendment to Companies (Appointment and Qualification of Directors) Rules.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_are_Things_to_be_kept_in_mind_while_filing_DIR-3_e-Form_KYC\"><\/span><span style=\"color: #ff6600;\"><strong>What are Things to be kept in mind while filing DIR-3 e-Form KYC<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li>In the case of the Director have to provide his Mobile No &amp; email id while filing this e-form. This information will be verified by an OTP.<\/li>\n<li>Directors will have to use their DSC sign for e filing this e-Form<\/li>\n<li>The Directors will have to ensure that e-Form is certified by practicing the profession like a CA or CWA or CS,<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">This form should be duly certified by a practicing professional (CA\/CS\/CMA).<\/p>\n<p style=\"text-align: justify;\">Filing of DIR-3 KYC would be mandatory for disqualified directors also.<\/p>\n<p style=\"text-align: justify;\">There is no filing fees for DIR-3 KYC, however, if the form is filed after the due date, there is a penalty fee of Rs. 5,000 perform.<\/p>\n<h1><span class=\"ez-toc-section\" id=\"Who_is_needed_to_File_e-Form_DIR_3_KYC\"><\/span><span id=\"Who_is_required_to_File_e-Form_DIR_3_KYC-WEB\" style=\"color: #ffcc00;\"><strong><b>Who is needed to File e-Form DIR 3 KYC?<\/b><\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p style=\"text-align: justify;\">Every Director who has been allotted DIN on or before 31st March 2018 and whose DIN is in \u2018Approved\u2019 status, would be mandatorily required to file form DIR-3 KYC on or before 31st August 2018.<\/p>\n<p style=\"text-align: justify;\">Otherwise, LATE FEES PENALTY 5000 FROM 1 Sept 2018 AND DIN WILL BE DEACTIVATED.<\/p>\n<h2 id=\"Guide\"><span class=\"ez-toc-section\" id=\"Basic_Guidance_on_filing_Eform_DIR-3_KYC\"><\/span><span style=\"color: #ffcc00;\">Basic Guidance on filing Eform DIR-3 KYC<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>When we required to filing the eForm DIR 3 -KYC form, the following important point to be noted :<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Important_points_to_be_noticed\"><\/span><span style=\"color: #000080;\"><strong>Important points to be noticed:-<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li style=\"text-align: justify;\">Filing of DIR-3 KYC would be mandatory for Disqualified Directors also.<\/li>\n<li style=\"text-align: justify;\">e-Form DIR \u2013 3 KYC, need to file based on DIRECTOR IDENTIFICATION NUMBER (DIN), so even though, if any Director holding multiple Directorship in Company.<\/li>\n<li style=\"text-align: justify;\">then also they need to File e-Form DIR \u2013 3 KYC, only once according to their DIN.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" Practicing Chartered Accountant , Practicing Cost Accountant<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Documents_Required_for_Form_DIR-3-KYC\"><\/span><span style=\"color: #000080;\"><strong>Documents Required for <\/strong><\/span><span style=\"color: #000080;\"><strong>Form DIR-3-KYC <\/strong><\/span><span style=\"color: #000080;\"><strong>:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li>DSC of Director duly Registered;<\/li>\n<li>Self-attested PAN card;<\/li>\n<li>A Self-attested Aadhar card with the updated Mobile number with UIDAI;<\/li>\n<li>The Self-attested Electricity Bill, Mobile Bill, Bank statement of Director (latest 2 Months) of his\/her present address;<\/li>\n<li>Latest Passport size photo;<\/li>\n<li>DIN declaration cum KYC.<\/li>\n<li>Passport (mandatory for foreign national holding DIN.<\/li>\n<\/ul>\n<h3 style=\"color: #000080;\">What are the Attachments to be made while filling the forms?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Eform filling applicant must upload the below documents.\u00a0 You make sure to get the below E-forms attested too before filling with MCA form uploading:<\/p>\n<ul>\n<li>Copy of Aadhaar Card.<\/li>\n<li>Conditional attachments.<\/li>\n<li>Proof of present address.<\/li>\n<li>A Copy of Passport.<\/li>\n<li>Proof of Permanent address.<\/li>\n<\/ul>\n<p><strong>Note:<\/strong><\/p>\n<ul>\n<li>Any other optional attachments should be DSC signed by the applicant of E Form.<\/li>\n<li style=\"text-align: justify;\">DIR-3 KYC Will be deployed from 10.07.2018. it is applicable to all Individuals holding DIN.<\/li>\n<li style=\"text-align: justify;\">THE first DIR3 KYC is needed to be filed by all Individuals who have been allotted DIN on or before March 31, 2018, need to file DIR-3 KYC on or before August 31, 2018.<\/li>\n<li style=\"text-align: justify;\">Thereafter, DIR-3 KYC needs to be filed every year by all Individuals on or before April 30th every year<\/li>\n<li>After the expiry of the due date by which the e-KYC form is to be filed, the MCA-21 system will mark all approved DINs (allotted on or before March 31, 2018) against which DIR-3 KYC forms have not been filed as &#8216;deactivated&#8217; with a reason as &#8216;non-filing of DIR-3 KYC&#8217;.<\/li>\n<\/ul>\n<h1><span class=\"ez-toc-section\" id=\"Certification_of_e-form_DIR-3_KYC\"><\/span><span style=\"color: #ff9900;\">Certification of e-form DIR-3 KYC.<\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<ul>\n<li>Ensure that a chartered accountant\/cost accountant practical or corporate secretary digitally signs the eForm. For future MCA communication, this SRN is to be used.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Step_3_Furnish_the_Required_Details_in_the_DIR-_3_KYC_Form\"><\/span><span style=\"color: #000080;\">Step 3: Furnish the Required Details in the DIR- 3 KYC Form<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #000080;\"><strong>All the later Communication with email<\/strong><\/span><\/p>\n<p>An email will be sent to the applicant&#8217;s personal email identification with the approval of the receipt of the form. Once you receive your e-mail approval, you have completed the eForm KYC DIR-3.<\/p>\n<h2 id=\"consequence\"><span class=\"ez-toc-section\" id=\"What_is_the_consequence_of_nonfilling_of_DIR-3_KYC_within_Due_Date\"><\/span><span style=\"color: #ff9900;\">What is the consequence of nonfilling of DIR-3 KYC within Due Date:<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li>In the event a Director who should submit the e-Form does not submit it on the MCA 21 portal by 30 September, the department shall mark such manager&#8217;s DIN as &#8216;Deactivated because a DIR-3 KYC has not been filed.&#8217;<\/li>\n<li>If the director wishes to re-activate his DIN in the future by filing the missed out eForm DIR-3 KYC, he can do so after paying a late fee of Rs 5,000.<\/li>\n<li>This fee is due on or after 30 September of the year the DIR-3 eForm is to be filed.
