refers to income earned or derived outside of India (except income derived from a business controlled in or a profession set up in India).<\/p>\n<p><a href=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/03\/Budget-2020-Impact-on-NRIs-7.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-12329\" src=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/03\/Budget-2020-Impact-on-NRIs-7.png\" alt=\"\" width=\"944\" height=\"477\" srcset=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/03\/Budget-2020-Impact-on-NRIs-7.png 944w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/03\/Budget-2020-Impact-on-NRIs-7-300x152.png 300w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/03\/Budget-2020-Impact-on-NRIs-7-768x388.png 768w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/03\/Budget-2020-Impact-on-NRIs-7-800x404.png 800w\" sizes=\"(max-width: 944px) 100vw, 944px\" \/><\/a><\/p>\n<p>Individuals who do not meet any of the aforementioned criteria are considered non-residents of India (<a href=\"https:\/\/carajput.com\/blog\/category\/nri\/\">NRI<\/a>).<\/p>\n<p>The above-mentioned second requirement will not apply in the following circumstances:<\/p>\n<ul>\n<li>Any Indian citizen leaving the country for the aim of finding work (including self-employment) outside the country.<\/li>\n<li>Indian citizens fleeing the country as members of an Indian ship&#8217;s crew.<\/li>\n<li>Any individual of Indian ancestry or an Indian citizen residing outside of India who visits India.<\/li>\n<\/ul>\n<p><strong>Additional Requirements<\/strong><\/p>\n<p>If a person meets any of the primary criteria, they are considered an Indian citizen.<\/p>\n<p>To become an Ordinary Resident of India, they must also meet the following two requirements:<\/p>\n<p>Out of the previous ten financial years, the person spent at least two years in India directly before the current financial year AND<\/p>\n<ol>\n<li>Out of the previous seven financial years, the person spent at least 730 days in India immediately before the current financial year.<\/li>\n<li>If any of the aforementioned qualifications are not met, a person becomes a Not Ordinary Resident of India (RNOR).<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">If one of the above conditions is satisfied then he is a resident of India as per <a href=\"https:\/\/www.caindelhiindia.com\/blog\/implication-of-cash-transaction-under-income-tax-act\/\">Income Tax<\/a>.<\/span> Non-Resident in India if he satisfies none of the basic conditions.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"RESIDENT_AND_ORDINARILY_RESIDENT_OR_RESIDENT_BUT_NOT_ORDINARILY_RESIDENT\"><\/span><strong>RESIDENT AND ORDINARILY RESIDENT OR RESIDENT BUT NOT ORDINARILY RESIDENT<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<figure id=\"attachment_12177\" aria-describedby=\"caption-attachment-12177\" style=\"width: 969px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-by-RJA...jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-12177\" src=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-by-RJA...jpg\" alt=\"residential-status by RJA\" width=\"969\" height=\"486\" srcset=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-by-RJA...jpg 969w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-by-RJA..-300x150.jpg 300w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-by-RJA..-768x385.jpg 768w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-by-RJA..-800x401.jpg 800w\" sizes=\"(max-width: 969px) 100vw, 969px\" \/><\/a><figcaption id=\"caption-attachment-12177\" class=\"wp-caption-text\">residential-status by RJA<\/figcaption><\/figure>\n<p style=\"text-align: justify;\">If the Individual fulfills one the following conditions then he said to be a resident but not ordinarily resident of India:<\/p>\n<ol style=\"text-align: justify;\">\n<li>An Individual is a non-resident in India for 9 years out of 10 years immediately before the relevant financial year.<\/li>\n<li>An Individual is in India for a period of less than 729 days during 7 years immediately before the relevant financial year.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Else, he is considered as a resident and ordinarily resident in India.<\/p>\n<p style=\"text-align: justify;\">These conditions need to be tested every year for every Individual.<\/p>\n<ol style=\"text-align: justify;\">\n<li>When you are calculating the number of days, you have to include the day you left India and the day you arrived in India as part of your total stay in India.<br \/>\n2. Stay in India includes staying in territorial waters of India i.e. up to 12 nautical miles into the sea.<br \/>\n3. The stay need not be continuous. All different periods of stay in India have to be added up.<\/li>\n<\/ol>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"RESIDENTIAL_STATUS_OF_HUF\"><\/span><strong>RESIDENTIAL STATUS OF<a href=\"https:\/\/carajput.com\/services\/hindu-undivided-family.php\"> HUF<\/a><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><a href=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-huf-.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-12174\" src=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-huf-.jpg\" alt=\"residential status of an huf\" width=\"782\" height=\"782\" srcset=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-huf-.jpg 225w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-huf--150x150.jpg 150w\" sizes=\"(max-width: 782px) 100vw, 782px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">A <a href=\"https:\/\/carajput.com\/services\/hindu-undivided-family.php\">Hindu undivided family<\/a> is said to be a resident in India if the control and management of its affairs is wholly or partly situated in India.<\/p>\n<p style=\"text-align: justify;\">A Hindu undivided family is a non-resident in India if the control and management of its affairs is wholly situated out of India.<\/p>\n<p style=\"text-align: justify;\">\u00a0In order to determine whether a Hindu Undivided Family is a resident or a non-resident, the residential status of the karta of the family during the previous year is not relevant<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Residential_status_of_a_company\"><\/span><span style=\"color: #000080;\"><strong>Residential status of a company<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<figure id=\"attachment_12175\" aria-describedby=\"caption-attachment-12175\" style=\"width: 957px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-COMPANY.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-12175\" src=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-COMPANY.jpg\" alt=\"residential status of an COMPANY \" width=\"957\" height=\"718\" srcset=\"https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-COMPANY.jpg 728w, https:\/\/carajput.com\/blog\/wp-content\/uploads\/2018\/04\/residential-status-of-an-COMPANY-300x225.jpg 300w\" sizes=\"(max-width: 957px) 100vw, 957px\" \/><\/a><figcaption id=\"caption-attachment-12175\" class=\"wp-caption-text\"><strong><span style=\"text-align: justify; font-size: 16px;\">An Indian company is always resident in India. <\/span><\/strong><span style=\"text-align: justify; font-size: 16px;\">Foreign company is resident in India only if during the previous year, control and management of its affairs is situated wholly in India. <\/span><span style=\"text-align: justify; font-size: 16px;\">Conversely, a foreign company is treated as non-resident if during the previous year, control and management of its affairs is either is wholly or partly situated out of India. <\/span><span style=\"text-align: justify; font-size: 16px;\">\u00a0Company can never be ordinarily or not ordinarily resident in India.<\/span><\/figcaption><\/figure>\n<p><b>Other people<\/b><\/p>\n<p style=\"text-align: justify;\">Every other person is resident in India if control and management of his affairs is, wholly or partly, situated within India during the relevant previous.<\/p>\n<p style=\"text-align: justify;\">On the other hand, every other person is non-resident in India if control and management of its affairs is wholly situated outside India.<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Residential_status_and_income_to_be_taxed_in_India\"><\/span><span style=\"color: #000080;\"><strong>Residential status and income to be taxed in India<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ol style=\"text-align: justify;\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"If_you_are_an_NR_Non-Resident\"><\/span><strong> If you are an NR (Non-Resident)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h3><span class=\"ez-toc-section\" id=\"a_You_are_liable_to_pay_tax_%E2%80%9Conly%E2%80%9D_on_the_income_earned_in_India\"><\/span>a) You are liable to pay tax &#8220;only&#8221; on the income earned in India.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>b) You are &#8220;not taxed&#8221; on any income earned outside India &#8220;nor&#8221; on the income earned outside India out of a business controlled from\u00a0India or a profession set-up in India<strong>2. <\/strong><\/li>\n<li><strong>If you are RNOR (resident but not ordinarily resident)<\/strong><br \/>\na) You are liable to pay tax on the income earned in India + on the income earned outside India out of a business controlled from India or a professional set-up in India<br \/>\nb) we are &#8220;not taxed&#8221; on any income earned outside India<strong>3.
