Determinate (Known) Shares :\u00a0If the individual shares of the members are known, taxation works as follows:<\/p>\n<ul data-start=\"798\" data-end=\"1204\">\n<li data-start=\"798\" data-end=\"940\">\n<p data-start=\"800\" data-end=\"940\">The AOP is taxed at the same slab rates applicable to individuals, <em data-start=\"871\" data-end=\"879\">unless<\/em> any member\u2019s total income exceeds the basic exemption limit.<\/p>\n<\/li>\n<li data-start=\"941\" data-end=\"1033\">\n<p data-start=\"943\" data-end=\"1033\">If no member has income above the basic exemption limit, the AOP enjoys slab benefits.<\/p>\n<\/li>\n<li data-start=\"1034\" data-end=\"1204\">\n<p data-start=\"1036\" data-end=\"1204\">In case even 1 member has income above the basic exemption limit, the entire income of the AOP is taxed at the Maximum Marginal Rate (MMR) for that member\u2019s share.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1206\" data-end=\"1247\">2. Indeterminate (Unknown) Shares :\u00a0If the members&#8217; shares are not specified or cannot be determined, Section 167B mandates:<\/p>\n<ul data-start=\"1342\" data-end=\"1525\">\n<li data-start=\"1342\" data-end=\"1421\">\n<p data-start=\"1344\" data-end=\"1421\">The entire income of the AOP is taxed at the Maximum Marginal Rate (MMR).<\/p>\n<\/li>\n<li data-start=\"1422\" data-end=\"1525\">\n<p data-start=\"1424\" data-end=\"1525\">MMR currently refers to 30% + surcharge + cess, or the highest rate applicable under the Act.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1527\" data-end=\"1553\"><span class=\"ez-toc-section\" id=\"What_about_the_role_of_Section_86_of_Income_Tax_Act\"><\/span><span style=\"color: #000080;\"><strong>What about the role of Section 86 of Income Tax Act?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1527\" data-end=\"1553\">Section 86 ensures Fair and equitable taxation, Avoidance of double taxation, Uniform treatment of AOP members based on the AOP\u2019s tax profile &amp; Transparency in income allocation and tax liability. Section 86 determines whether income taxed in the hands of the AOP is also taxable in the hands of members, depending on the situation:<\/p>\n<ul>\n<li data-start=\"1699\" data-end=\"1834\">\n<p data-start=\"1701\" data-end=\"1834\">When the AOP is Taxed at MMR :\u00a0 If the AOP is taxed at MMR, members do not pay tax again on the share of income received from AOP (to avoid double taxation).\u00a0If the AOP is chargeable at the Maximum Marginal Rate u\/s 167B: The member\u2019s share of income from the AOP is completely exempt in their hands.\u00a0This prevents the same income from being taxed twice \u2014 once at the AOP level, and again at the member level.\u00a0Example If the AOP is taxed at 30% + surcharge + cess, the member pays no tax on the share received.<\/p>\n<\/li>\n<li data-start=\"1835\" data-end=\"1960\">\n<p data-start=\"1837\" data-end=\"1960\">In case AOP is Taxed at Normal Slab Rates : If AOP is taxed at normal slab rates, the member\u2019s share may be taxable or exempt depending on their individual status.\u00a0\u00a0If the AOP is not taxed at MMR and instead enjoys individual slab rates: \u00a0The member\u2019s share of income from the AOP is included in their total income. However, the member gets a rebate (u\/s 86) for the amount of tax already paid by the AOP on that income. This ensures the member is not taxed twice.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"314\" data-end=\"636\"><span style=\"color: #000080;\"><strong>Taxation can happen in two ways:<\/strong><\/span><\/p>\n<ol>\n<li>Tax at the AOP Level : The AOP pays tax at Maximum marginal rate, OR Normal slab rates (if share of members is determinate and none has income above taxable limit)<\/li>\n<li>Tax in Hands of Members : In certain cases, income is apportioned to members and taxed individually (rare under current provisions).
