These guidelines are designed to ensure compliance with the Prevention of Money Laundering Act 2002 and to mitigate risks associated with money laundering and terrorist financing. These guidelines, approved by the Director of FIN IND, aim to strengthen the compliance framework within the VDA sector, ensuring that Principal Officers are equipped to effectively manage and mitigate risks associated with virtual digital assets.<\/p>\n<h3 data-start=\"407\" data-end=\"451\"><span class=\"ez-toc-section\" id=\"Key_Requirements_for_Principal_Officers_in_relation_for_Virtual_Digital_Asset_Service_Providers\"><\/span><span style=\"color: #000080;\"><strong data-start=\"407\" data-end=\"451\">Key Requirements for Principal Officers in relation <\/strong><strong>for Virtual Digital Asset Service Providers<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ol data-start=\"453\" data-end=\"2656\">\n<li data-start=\"453\" data-end=\"556\">\n<p data-start=\"456\" data-end=\"556\"><span style=\"color: #000080;\"><strong data-start=\"456\" data-end=\"486\">Management Level Position:<\/strong> <\/span>The Principal Officer must hold a management-level position within the organization.<\/p>\n<\/li>\n<li data-start=\"558\" data-end=\"750\">\n<p data-start=\"561\" data-end=\"750\"><span style=\"color: #000080;\"><strong data-start=\"561\" data-end=\"581\">Exclusive Focus:<\/strong><\/span> To prevent conflicts of interest, the Principal Officer should be dedicated solely to responsibilities under Chapter IV of the Prevention of Money Laundering Act 2002 and should not engage in other business operations.<\/p>\n<\/li>\n<li data-start=\"752\" data-end=\"903\">\n<p data-start=\"755\" data-end=\"903\"><span style=\"color: #000080;\"><strong data-start=\"755\" data-end=\"780\">Full-Time Engagement:<\/strong> <\/span>The Principal Officer must be exclusively employed by a single Virtual Digital Asset Service Providers on a full-time basis, without any concurrent engagements elsewhere.<\/p>\n<\/li>\n<li data-start=\"905\" data-end=\"1077\">\n<p data-start=\"908\" data-end=\"1077\"><span style=\"color: #000080;\"><strong data-start=\"908\" data-end=\"939\">Authority and Independence:<\/strong><\/span> The Principal Officer should possess sufficient seniority to perform duties autonomously, free from internal bureaucratic hindrances or undue influence.<\/p>\n<\/li>\n<li data-start=\"1079\" data-end=\"1328\">\n<p data-start=\"1082\" data-end=\"1328\"><span style=\"color: #000080;\"><strong data-start=\"1082\" data-end=\"1106\">Relevant Experience:<\/strong> <\/span>A minimum of three years of experience in legal and compliance matters related to anti-money laundering is required. The Principal Officer should be well-versed in the obligations under the Prevention of Money Laundering Act, associated rules, and regulations.<\/p>\n<\/li>\n<li data-start=\"1330\" data-end=\"1592\">\n<p data-start=\"1333\" data-end=\"1592\"><span style=\"color: #000080;\"><strong data-start=\"1333\" data-end=\"1352\">Risk Awareness:<\/strong><\/span> The Principal Officer should have comprehensive knowledge of money laundering and terrorist financing risks pertinent to the country, the organization, and the Virtual Digital Asset Sector. Staying informed about emerging trends and typologies in these areas is essential.<\/p>\n<\/li>\n<li data-start=\"1594\" data-end=\"1870\">\n<p data-start=\"1597\" data-end=\"1870\"><span style=\"color: #000080;\"><strong data-start=\"1597\" data-end=\"1634\">Participation in Risk Committees:<\/strong> <\/span>The Principal Officer should be a permanent invitee to high-level committees that assess risks associated with products, services, and delivery channels, ensuring proper identification and mitigation of money laundering and terrorist financing risks.<\/p>\n<\/li>\n<li data-start=\"1872\" data-end=\"2129\">\n<p data-start=\"1875\" data-end=\"2129\"><span style=\"color: #000080;\"><strong data-start=\"1875\" data-end=\"1898\">Adequate Resources:<\/strong> <\/span>The Principal Officer must have access to sufficient resources, including support staff with necessary expertise, and unhindered access to relevant information to effectively monitor transactions and implement the organization&#8217;s anti-money laundering\/Countering Financing of Terrorism program.<\/p>\n<\/li>\n<li data-start=\"2131\" data-end=\"2336\">\n<p data-start=\"2134\" data-end=\"2336\"><span style=\"color: #000080;\"><strong data-start=\"2134\" data-end=\"2165\">Prompt Information Sharing:<\/strong><\/span> The organization should have internal guidelines to ensure that the Principal Officer can promptly respond to information requests from Financial Intelligence Unit-India, law enforcement agencies, or regulators.<\/p>\n<\/li>\n<li data-start=\"2338\" data-end=\"2516\">\n<p data-start=\"2342\" data-end=\"2516\"><span style=\"color: #000080;\"><strong data-start=\"2342\" data-end=\"2364\">Regular Reporting:<\/strong><\/span> The Principal Officer should present regular reviews or status updates of the anti-money laundering \/Countering Financing of Terrorism\u00a0function to the Board or a Board sub-committee, preferably on a quarterly basis.<\/p>\n<\/li>\n<li data-start=\"2518\" data-end=\"2656\">\n<p data-start=\"2522\" data-end=\"2656\"><span style=\"color: #000080;\"><strong data-start=\"2522\" data-end=\"2546\">Location Preference:<\/strong> <\/span>It is preferable for the Principal Officer to be based in India to effectively handle obligations related to the Virtual Digital Asset sector.<\/p>\n<\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"Compliance_obligations_framework_of_Service_Providers_including_Virtual_Digital_Asset_Service_Providers\"><\/span><span style=\"color: #000080;\">Compliance obligations framework of Service Providers including Virtual Digital Asset Service Providers<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"0\" data-end=\"249\">These obligations emphasize the compliance framework that Service Providers (SPs), including Virtual Digital Asset Service Providers (VDA SPs), must adhere to under the <strong data-start=\"169\" data-end=\"214\">Prevention of Money Laundering Act (PMLA)<\/strong> and its rules. Here\u2019s a breakdown:<\/p>\n<h3 data-start=\"251\" data-end=\"317\"><span class=\"ez-toc-section\" id=\"Registration_of_Service_Providerss_as_Reporting_Entities_with_Financial_Intelligence_Unit-India\"><\/span><span style=\"color: #000080;\"><strong data-start=\"255\" data-end=\"317\">Registration of Service Providers&#8217;s as Reporting Entities with Financial Intelligence Unit-India<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This regulatory framework is essential for financial integrity, ensuring that Service Providers\u00a0 proactively identify and mitigate risks associated with virtual digital assets. As per Rule 2(wa) and Rule 2(sa) of Prevention of Money Laundering Act, all SPs must register as Reporting Entities with Financial Intelligence Unit-India. During registration, Service Providers must disclose their bank and financial institution (FI) account details where:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul data-start=\"550\" data-end=\"639\">\n<li data-start=\"550\" data-end=\"609\">Transactions related to their business are conducted.<\/li>\n<li data-start=\"612\" data-end=\"639\">Client Money is held.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 data-start=\"641\" data-end=\"672\"><span class=\"ez-toc-section\" id=\"AMLCFTCPF_Program\"><\/span><span style=\"color: #000080;\"><strong data-start=\"645\" data-end=\"672\">AML\/CFT\/CPF Program: <\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"641\" data-end=\"672\"><span style=\"font-size: 16px;\">As per <\/span>Rule 7(3) of the PML Rules (Prevention of Money Laundering\u00a0 Regulation)<span style=\"font-size: 16px;\">, Service Providers must establish an <\/span>internal mechanism<span style=\"font-size: 16px;\"> to detect and report transactions related to:<\/span><\/p>\n<ul data-start=\"673\" data-end=\"1126\">\n<li data-start=\"673\" data-end=\"950\">\n<ul data-start=\"814\" data-end=\"950\">\n<li data-start=\"814\" data-end=\"841\">Money Laundering<\/li>\n<li data-start=\"844\" data-end=\"874\">Terrorist Financing<\/li>\n<li data-start=\"877\" data-end=\"911\">Proliferation Financing<\/li>\n<li data-start=\"914\" data-end=\"950\">Other serious financial crimes<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"951\" data-end=\"1126\">Service Providers must ensure compliance with Rule 3(1) by:\n<ul data-start=\"1005\" data-end=\"1126\">\n<li data-start=\"1005\" data-end=\"1062\">Identifying and monitoring suspicious transactions.<\/li>\n<li data-start=\"1065\" data-end=\"1126\">Furnishing reports on such transactions to FIU-IND.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 data-start=\"0\" data-end=\"66\"><span class=\"ez-toc-section\" id=\"Obligation_of_Reporting_Entities_under_Rule_74_of_PMLR\"><\/span><span style=\"color: #000080;\"><strong data-start=\"4\" data-end=\"64\">Obligation of Reporting Entities under Rule 7(4) of PMLR<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"68\" data-end=\"409\">Under Rule 7(4) of the PML Rules (PMLR), Reporting Entities including Service Providers and Virtual Digital Asset Service Providers must implement effective internal controls to prevent and impede:<\/p>\n<ul>\n<li data-start=\"68\" data-end=\"409\">Money Laundering<\/li>\n<li data-start=\"68\" data-end=\"409\">Terrorist Financing<\/li>\n<li data-start=\"68\" data-end=\"409\">Proliferation Financing<\/li>\n<\/ul>\n<p data-start=\"68\" data-end=\"409\">This obligation extends to Designated Director, Principal Officer (PO) and All officers and employees<\/p>\n<h3 data-start=\"536\" data-end=\"590\"><span class=\"ez-toc-section\" id=\"Requirement_for_a_Robust_AMLCFTCPF_Program\"><\/span><span style=\"color: #000080;\"><strong data-start=\"540\" data-end=\"588\">Requirement for a Robust AML\/CFT\/CPF Program:\u00a0<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This framework is critical for Service Providers to comply with legal obligations and mitigate financial crime risks in the Virtual Digital Assets (VDA) sector.
