These amendments, effective from 3rd February 2025, aim to streamline insolvency proceedings, particularly for real estate projects, and ensure better transparency and protection for stakeholders. Here\u2019s a summary of the key features and their implications:<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Key_Features_of_the_CIRP_Amendments_Regulations\"><\/span><span style=\"color: #000080;\">Key Features of the\u00a0<strong>CIRP Amendments Regulations\u00a0<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ol>\n<li><span style=\"color: #000080;\"><strong>Homebuyer Relief:\u00a0<\/strong><\/span>Resolution professionals can now hand over possession of property to homebuyers during the resolution process once they receive approval from at least 66% of the total votes of the CoC. This is a major step forward in addressing the concerns of homebuyers in ongoing real estate projects.<\/li>\n<li><span style=\"color: #000080;\"><strong>Enhanced Creditor Representation:\u00a0<\/strong><\/span>Facilitators will now be appointed to ensure better representation of creditors, especially when the number of creditors is large. This will facilitate better decision-making based on clear insights into the project\u2019s status.<\/li>\n<li><strong><span style=\"color: #000080;\">Relaxed Eligibility for Homebuyer Associations:<\/span> <\/strong>CoCs have been granted the flexibility to relax eligibility and financial requirements for homebuyer associations submitting resolution plans, which will encourage more participation from such associations.<\/li>\n<li><strong><span style=\"color: #000080;\">Monitoring Committee:<\/span>\u00a0<\/strong>A monitoring committee may be formed to oversee the implementation of the resolution plan, providing quarterly progress reports. Due to the following reason, this matters:\n<ul>\n<li>Previously, land authorities (operational creditors) were excluded from CoC discussions, leading to regulatory delays.<\/li>\n<li>Their inclusion enhances clarity on land-related approvals and compliance issues.<\/li>\n<li>However, they do not get voting rights in CoC decisions.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 style=\"padding-left: 40px;\"><span class=\"ez-toc-section\" id=\"7_Handover_of_Possession_During_Resolution_Process\"><\/span><span style=\"color: #000080;\"><strong>7. This is matters due to the following reason:?\n<ul>\n<li>Ensures that homebuyers who have fulfilled obligations can get possession without waiting for CIRP completion.<\/li>\n<li>Aligns with past court rulings that flats\/houses under construction are not corporate debtor assets and should be transferred to rightful owners.<\/li>\n<li>Protects homebuyer interests and keeps the real estate project running as a going concern.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3 style=\"padding-left: 40px;\"><span class=\"ez-toc-section\" id=\"8_Appointment_of_Facilitators_for_Large_Creditor_Classes\"><\/span><span style=\"color: #000080;\"><strong>8. Appointment <\/strong><strong>of Facilitators for Large Creditor Classes<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"padding-left: 80px;\">New IBBI Regulation 16D allows CoC to appoint up to five facilitators to assist sub-classes within creditor groups (if the class has more than 1,000 creditors). Allows CoC to appoint up to five facilitators for the purpose of enhancing communication in large CIRPs where creditor interests vary. And it reduces the burden on authorized representatives and ensures better representation.
