Since unsecured loans are not considered as &#8220;supplies&#8221; under GST, the Input Tax Credit availed on inputs used for such loans is not eligible for reversal.<\/p>\n<p>However, if the unsecured loans are later converted into taxable supplies, the Input Tax Credit related to the inputs used for making these supplies would need to be reversed in accordance with Section 17(2) of the THE CENTRAL GOODS AND SERVICES TAX\u00a0<em>ACT<\/em>,\u00a0<em>2017<\/em>. This section governs the apportionment of credit and specifies instances where credit must be reversed.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"In_Summary\"><\/span><span style=\"color: #000080;\">In Summary:<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>No Input Tax Credit reversal is required when unsecured loans remain loans (not considered supplies).<\/li>\n<li>If the loans are converted into taxable supplies, Input Tax Credit reversal would be required under <em>Goods and Services Tax <\/em>law as per Section 17(2) of the THE CENTRAL GOODS AND SERVICES TAX\u00a0<em>ACT<\/em>,\u00a0<em>2017.<\/em><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Conditions_for_Input_Tax_Credit_ITC_reversal\"><\/span><span style=\"color: #000080;\"><strong>Conditions for Input Tax Credit (ITC) reversal<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>When businesses pay taxes to the government, they can use the Input Tax Credit on <em>Goods and Services Tax <\/em>paid for their purchases, like raw materials or services used in the manufacturing or selling of products. But, if Input Tax Credit is wrongly claimed, it must be reversed by making the appropriate payment in the subsequent month.<\/p>\n<h2 data-start=\"200\" data-end=\"264\"><span class=\"ez-toc-section\" id=\"GST_Deep_Dive_ITC_Reversals%E2%80%94Where_Most_Taxpayers_Slip\"><\/span><span style=\"color: #000080;\"><strong data-start=\"203\" data-end=\"264\">GST Deep Dive | ITC Reversals\u2014Where Most Taxpayers Slip<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-start=\"266\" data-end=\"493\">Input Tax Credit (ITC) under GST is conditional, not absolute. A significant number of disputes arise not because credit is ineligible, but due to missed reversals, delayed compliance, or weak tracking mechanisms.\u00a0Let\u2019s decode the key ITC reversal provisions under GST and why they matter<\/p>\n<h3 data-start=\"583\" data-end=\"626\"><span class=\"ez-toc-section\" id=\"Rule_37_%E2%80%93_Payment-Based_Reversal\"><\/span><span style=\"color: #000080;\"><strong data-start=\"590\" data-end=\"626\">Rule 37 \u2013 Payment-Based Reversal<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"627\" data-end=\"820\">If payment to the supplier (including GST) is not made within 180 days from the invoice date, ITC must be reversed in GSTR-3B. The credit can be re-availed once payment is made.<\/p>\n<h3 data-start=\"827\" data-end=\"872\"><span class=\"ez-toc-section\" id=\"Rule_37A_%E2%80%93_Supplier_Return_Default\"><\/span><span style=\"color: #000080;\"><strong data-start=\"834\" data-end=\"872\">Rule 37A \u2013 Supplier Return Default<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"873\" data-end=\"1041\">Introduced to strengthen compliance discipline in the GST chain. If the supplier fails to file GSTR-3B, the recipient is required to reverse ITC, even if Tax invoice is valid, and payment has been made to the supplier. \u00a0ITC becomes available again once the supplier files the return.<\/p>\n<h3 data-start=\"1192\" data-end=\"1236\"><span class=\"ez-toc-section\" id=\"Rule_38_%E2%80%93_Banking_NBFC_Reversal\"><\/span><span style=\"color: #000080;\"><strong data-start=\"1199\" data-end=\"1236\">Rule 38 \u2013 Banking &amp; NBFC Reversal<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1237\" data-end=\"1442\">Banks, NBFCs, and financial institutions may opt for a fixed percentage ITC reversal instead of invoice-level tracking. \u00a0Once exercised, the option is irrevocable for the entire financial year.<\/p>\n<h3 data-start=\"1449\" data-end=\"1506\"><span class=\"ez-toc-section\" id=\"Rule_42_%E2%80%93_Common_ITC_Inputs_Input_Services\"><\/span><span style=\"color: #000080;\"><strong data-start=\"1456\" data-end=\"1506\">Rule 42 \u2013 Common ITC (Inputs &amp; Input Services)<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1507\" data-end=\"1608\">Applicable where inputs or services are used for both taxable and exempt supplies.Requires: Monthly provisional reversal and\u00a0annual final adjustment based on actual turnover.<\/p>\n<h3 data-start=\"1713\" data-end=\"1756\"><span class=\"ez-toc-section\" id=\"Rule_43_%E2%80%93_Capital_Goods_Reversal\"><\/span><span style=\"color: #000080;\"><strong data-start=\"1720\" data-end=\"1756\">Rule 43 \u2013 Capital Goods Reversal<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1757\" data-end=\"1896\">Where capital goods are used for both taxable and exempt supplies: \u00a0ITC must be reversed monthly over the useful life of 60 months.<\/p>\n<h3 data-start=\"1903\" data-end=\"1945\"><span class=\"ez-toc-section\" id=\"Section_175_%E2%80%93_Blocked_Credits\"><\/span><span style=\"color: #000080;\"><strong data-start=\"1910\" data-end=\"1945\">Section 17(5) \u2013 Blocked Credits<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1946\" data-end=\"2147\">Specified goods and services (e.g., certain motor vehicles, personal consumption, works contract for immovable property).
