The word &#8220;bogus&#8221; has not been used by the law: <\/span><span style=\"color: #000080;\">High Court<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li>GST Registration could be cancelled only if one of the 5 statutory conditions of Section 29(2) is fulfilled.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #000080;\"><strong>Complete Section 29(2) of GST Act\u00a0<\/strong><\/span><\/p>\n<p style=\"padding-left: 80px;\">(2)\u00a0The proper officer may cancel the registration of a person from such date, including any retrospective date, as he may deem fit, where,-<\/p>\n<p style=\"padding-left: 80px;\">(a) a registered person has contravened such provisions of the Act or the rules made thereunder as may be\u00a0prescribed; or<\/p>\n<p style=\"padding-left: 80px;\">(b) a person paying tax under\u00a0section 10\u00a0has not furnished\u00a0<sup>3<\/sup>[the return for a financial year beyond three months from the due date of furnishing the said return]\u200b; or<\/p>\n<p style=\"padding-left: 80px;\">(c) any registered person, other than a person specified in clause (b), has not furnished returns for a\u00a0<sup>4<\/sup>[such continuous tax period as may be prescribed]; or<\/p>\n<p style=\"padding-left: 80px;\">(d) any person who has taken voluntary registration under sub-section (3) of\u00a0section 25\u00a0has not commenced business within six months from the date of registration; or<\/p>\n<p style=\"padding-left: 80px;\">(e) registration has been obtained by means of fraud, wilful misstatement or suppression of facts:<\/p>\n<p style=\"padding-left: 80px;\"><strong>Provided\u00a0<\/strong>that the proper officer shall not cancel the registration without giving the person an opportunity of being heard:<\/p>\n<p style=\"padding-left: 80px;\"><sup>1<\/sup>[<strong>Provided\u00a0<\/strong>further that during pendency of the proceedings relating to cancellation of registration, the proper officer may suspend the registration for such period and in such manner as may be\u00a0prescribed.]<\/p>\n<h3 style=\"padding-left: 40px;\"><span class=\"ez-toc-section\" id=\"High_Court_GST_Registration_may_not_be_cancelled_by_merely_describing_it_as_%E2%80%9CBogus%E2%80%9D_The_word_%E2%80%9Cbogus%E2%80%9D_has_not_been_used_by_the_law\"><\/span><strong><span style=\"color: #000080;\">High Court : GST Registration may not be cancelled by merely describing it as &#8220;Bogus&#8221;. The word &#8220;bogus&#8221; has not been used by the law<\/span><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>No registration may be cancelled simply by labelling the firm that received it as &#8220;bogus.&#8221;<\/li>\n<li>The term &#8220;bogus&#8221; is not used in the statute.
