If he considers it necessary, he shall place the note for consideration in the ensuing meeting of the CoC.<\/p>\n<p>&nbsp;<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3><span class=\"ez-toc-section\" id=\"Notice_Period-_CoC_Meeting_under_IBC_Regulation\"><\/span><span style=\"color: #000080;\"><strong>Notice Period- CoC Meeting under IBC Regulation<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>Not less than 5 days<\/li>\n<li>The committee may reduce the notice period from five days to such other period of not less than twenty-four hours, as it deems fit,<\/li>\n<li>Provided that the committee may reduce the period to such other period of not less than forty-eight hours if there is any authorised representative.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Who_should_notice_of_CoC_Meeting_be_served_to\"><\/span><span style=\"color: #000080;\"><strong>Who should notice of CoC Meeting be served to<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>Members of committee of creditors and authorised representatives<\/li>\n<li>The Members of the suspended Board of Directors or the partners of the corporate persons, as the case may be.<\/li>\n<li>Operational creditors or their representatives if the amount of their aggregate dues is not less than ten per cent of the debt.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"How_should_the_notice_of_CoC_Meeting_be_served_under_IBC_Regulation-_Reg_19\"><\/span><span style=\"color: #000080;\"><strong>How should the notice of CoC Meeting be served under IBC Regulation- Reg 19<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>By hand delivery<\/li>\n<li>By-post.<\/li>\n<li>But in any event, be served on every participant by electronic means.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Service_of_notice_by_electronic_mode_under_IBC_Regulation-_Reg_20\"><\/span><span style=\"color: #000080;\"><strong>Service of notice by electronic mode under IBC Regulation- Reg 20<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>Through e-mail as a text or as an attachment to e-mail or as a notification providing electronic link or URL for accessing such notice<\/li>\n<li>The subject line in e-mail shall state the name of the corporate debtor, the place, if any, the time and the date on which the meeting is scheduled<\/li>\n<li>In PDF with a &#8216;link or instructions&#8217; for recipient for downloading relevant version of the software.<\/li>\n<li>Retain proof of sending<\/li>\n<li>RP not responsible for a failure in transmission beyond its control.<\/li>\n<li>If a participant, other than a member of the committee, fails to provide or update the relevant e-mail address to the resolution professional, the non-receipt of such notice by such participant of any meeting shall not invalidate the decisions taken at such meeting.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Contents_of_the_notice_for_meeting_under_IBC_Regulation_Reg_21\"><\/span><span style=\"color: #000080;\"><strong>Contents of the notice for meeting under IBC Regulation Reg 21<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>Notice to mention:\n<ul>\n<li>the venue, the time and date of the meeting and of the option available to them to participate through video conferencing or other audio and visual means, e.g., \u201cNotice of the First meeting of the Committee of Creditors of ABC Ltd.
