Consequences When Aadhaar with PAN does not link till 31st March 2023

  • What will be the consequences if I do not link Aadhaar with PAN till 31st March 2023.. Your Permanent Account Number will become inoperative.
  • In case income tax taxpayer having Permanent Account Number and who is eligible to obtain Aadhaar card, does not link his Permanent Account Number with Aadhaar card on the Income Tax portal, upto 31 march 2023, Than  income tax taxpayer shall be liable to all applicable consequences under the income tax Act, in addition to Permanent Account Number remaining inoperative as per section 139AA.
  • Income tax Rule 114AAA provides that if Permanent Account Number of a income tax person become inoperative, he will not be able to furnish, or  quote or intimate his PAN and shall be liable to all consequences under the income tax Act for such kind of compliance failure.
  • In case PAN becomes inoperative, we will not be able to furnish, intimate or quote our Permanent Account Number and would be liable to all the consequences under the Act for such failure.

This will have a No of implications such as:

  1. We shall not be able to file Income tax return via using the inoperative Permanent Account Number
  2. Pending Income tax returns will not be processed
  3. Income tax refunds Pending cannot be issued to inoperative Permanent Account Numbers
  4. Pending proceedings as in the case of defective returns cannot be completed once the Permanent Account Number is inoperative Tax will be required to be deducted at a higher rate as Permanent Account Number becomes inoperative.
  5. Moreover, We might be face difficulty at various other fora like Nationalized or Private banks and other financial portals, as Permanent Account Number is one of important “Know Your Customer” criteria for all kinds of financial transactions.
  6. Presently, taxpayers must link their PANs to their Aadhaars by the deadline of March 31, 2023, or they will be charged a INR 1,000 late fee. Hence, before applying for the PAN-Aadhaar link on the Income Tax website, they must pay the penalty.

Income tax taxpayer can also go to a Permanent Account Number card centre, fill out the appropriate form and submit it with photocopies of Permanent Account Number and Aadhaar cards for Permanent Account Number-Aadhaar linking.
